The Dog Bit the Baby
The worst possible thing happened! The dog bit the baby while everyone else thought it would be a cute picture. Now, you’re in trouble.
The Scenario
Amy invited Jack to her baby shower as she was pregnant with her second child. Jack asked Amy if it was acceptable to bring Max, his Border Terrier, to the party. Amy replied it was okay because her first child, two-year-old Skylar, lived with two dogs, a Huskie and a French bulldog. Thus, the child was comfortable around dogs.
Jack brought Max to the party, and Skylar beamed with joy when she saw this other dog. However, she did not know the dog like she knew her pets. It was not a familiar situation. Thus, Skylar touched Max and touched the dog in a way he did not like, and he bit the baby. Everyone reacted, including Amy’s dogs, who rushed to Skylar’s defense and attacked Max. Amy is furious and has filed a claim against Jack.
The Claim
Amy is suing Jack for Max’s actions. She related that she had no idea that Max was an aggressive dog. Similarly, she brought up the fact that Skylar had experience with two dogs, and they never once bit her. Jack replied that Max does not bite unless antagonized and has never bitten a baby before. Similarly, he claimed that Amy allowed her baby to roam free without any supervision just for a picture.
Takeaways
Despite his best efforts, Jack is on the hook for this. Yes, he did have permission from the owner to bring Max to the party. But Amy did not know of Max’s discomfort around her child. Similarly, she could have double-checked to ensure Max could handle a baby. It also would have prevented her dogs from attacking Max in retaliation. The dog bit the baby because he felt stressed and overwhelmed. Unfortunately, it is a situation that both parties could have prevented.
