There’s a loose dog in your yard! It appeared out of nowhere, and you must figure out what to do. It is a situation that happens far too often, and it especially becomes troublesome when your dog becomes involved.

The Scenario

Jon minded his own business, and his dog was hanging out with him. Jon’s dog is a German Shepherd named Spike that notices everything. Suddenly, Spike’s head pops up. His ears extend, and he listens to a distant noise. A barking noise erupts from outside the house, and Spike reacts to it, moving closer to the sound. Jon attempts to discover what Spike is hearing, and then suddenly, he hears it too. It is the sound of a high-pitched barking dog. It is a Chihuahua. In that instant, Spike runs out the loosely-open screen door, confronts the Chihuahua, and ultimately gets into a scuffle.

The Claim

It turns out that the Chihuahua belonged to a neighbor named Karen down the street. Karen heard her dog barking and rushed out of the house, but unfortunately, she did not arrive in time. Spike attacked the Chihuahua, who was in Jon’s yard. Now, Karen is blaming Jon because Spike attacked her dog.

Takeaways

It is a precarious situation. Jon’s best friend minded his own business. However, Spike’s instinct to protect the house and the property has suddenly put Jon in hot water. It was going to be a relaxing day for Jon at home with Spike. Instead, Karen is making a claim of negligence against Jon.

Jon had never met Karen nor knew about the existence of the Chihuahua before that day. However, there was no fencing in his yard and nothing that could deter a loose animal.

In the future, Jon should find a way to prevent Spike from leaving the house when he is in there with him. Also, ensuring that he locked the backdoor would have prevented Spike from going through it.
