The dog bit you! He has never bitten you before, but he was in an uncomfortable situation that caused him considerable stress. When a dog bites because of a bad situation, it does not change the fact that you can still be liable for any claims that come through.

The Scenario

Jyll had a beagle named Rex, who she took everywhere with her. Today, Jyll decided to go to a picnic with her friends and brought Rex with her. Naturally, it is an environment with food. Dogs love food and will often make a pouty face at their owners. The park can also have some other factors that could cause stress. Rex sees dirt, and his eyes light up. He rushed toward the dirt and began to roll in it. Now, he’s making a mess! Jyll calls to Rex and reprimands him for rolling in the dirt. Then, Rex sees some food and runs after it. He leaps onto the table and devours the chicken on the table. Eric, a guy at the picnic, attempts to remove Rex by his head, and Rex responds by biting him.

Eric is suing Jyll for negligence. He claims she lavished and allowed Rex to run wild at a public picnic. Jyll replied that her dog never bites anyone. However, in this situation, Rex bit in self-defense because some stranger grabbed the dog by the head. Regardless, Jyll put her dog in a bad position in unfamiliar surroundings.
