When an Aggressive Dog Bites

Every dog can become aggressive. But when an owner ignores the signs and acts like nothing wrong will happen, it becomes a problem. Because when an aggressive dog bites, no one wins.

The Scenario

Jody was in a recreational soccer league, and she played every Friday night. Subsequently, she also brought her dog Astro with her every Friday. Jody warned everyone on the team that Astro was aggressive, possibly because of his upbringing before she adopted him. Furthermore, she warned everyone not to go near Astro and that she only brought him so he would not be alone at home. Jody keeps Astro on the bench around all the other players. However, the inevitable happens one day when someone gets too close to Astro, and the dog bites.

The Claim

The bite victim claimed they were just trying to get water, and Astro bit her unprovoked. Meanwhile, Jody insists that she warned everyone that Astro was an aggressive dog. But her teammates argue that they were there for recreational activities and had purposely gone near her dog, as he stood in the way of their water and cleats. Regardless, Jody is liable even though she warned everyone. She knew it was an aggressive dog and still brought him with her. Now, she is fully liable.

Jody should have used common sense. Unfortunately, many people like her do not think of the consequences of their actions. They then mistakenly believe that a small warning would be enough to prevent liability. Unfortunately for her, it is not the case, and now she is on the hook for damages caused by her aggressive dog.
