When Dogs Fight Each Other
It was supposed to be a simple dog walk in the park. Then, disaster struck when two dogs saw each other, and a fight broke out. When dogs fight each other, there are no winners. You only have a situation where dogs are hurt; no one wants that.
The Scenario
David had a rottweiler named Tank, who he adored and traveled with him everywhere. Likewise, Sean had a pit bull named Hector who always went with him. David was walking Tank at the nearby bar while Sean was walking Hector. Then, Tank and Hector locked eyes, and the dogs growled at one another. Before David and Sean could do anything, their dogs attacked each other. Now David and Sean both have grievances and are suing each other. What a mess!
The Claim
David claims that Hector instigated the fight. Conversely, Sean alleged that Tank initiated the fight. Ultimately, it is difficult to determine the actual fault when dogs fight each other. Tank and Hector growled at each other simultaneously, but Tank landed the first bite. Then, Hector retaliated with a bite of his own. It all happened in a second, and their owners could not stop it.
Takeaways
Tank landed the first bite so that David could be in trouble. However, Hector retaliated and landed a bite of his own. Both dogs attacked each other, and the vet bills will amount in both cases. Likewise, David and Sean have filed claims against one another, alleging liability.
David and Sean both could have prevented this. David could have held onto Tank, tugged at his collar, or distracted him. Likewise, Sean could have distracted Hector or steered him in another direction.
