When Someone Falsely Accuses Your Dog

You are minding your own business, going about your day. Then, you get a notice in the mail. You are being served for an alleged dog attack from over a year ago. However, you don’t remember your dog injuring anyone. You did not receive a report or any paperwork. The Scenario

Ron is an electrician in his 70s. He is physically fit and handles the job better than most. One day, he ventures into the home of Marsha, a woman with a house that needs electrical repair. However, Marsha’s dog Shilo startles Ron by jumping on him to say hello. Ron gets up, laughing it off, even petting the dog. Likewise, he even finishes the job in that same week. But Marsha gets the surprise of her life when she receives a lawsuit down the line from Ron claiming her dog contributed to his pelvis pain.

The Claim

Ron claims that the dog jumping on him led to his eventual pelvis pain. Additionally, he claims he had no injuries prior. But Ron continued to work, not just on this house, but on other homes. Moreover, there were no further incidents or mishaps. The pelvic pain increased approximately one year after the incident, despite no falls. Subsequently, Ron blamed the pain on the fall he suffered during the job. Marsha contended that there was no possible way her dog could have caused an injury that began a year later. However, Ron maintained his case.

Ron did not file any records, and Marsha did not record anything either. Therefore, while there is no proof her dog caused the injury, there are no records proving her dog did not hold responsibility for the injury, either. Ron also claimed the injury just before the statute of limitations took place. Amazingly, some states allow up to four years for a person to claim an injury sustained from a dog attack. Marsha now has this predicament of attempting to prove her dog’s innocence without verified evidence or records.
