When Your Dog Bites The Burglar
You heard a noise, and it startled you! The next thing you know, you see something running, and it takes you by surprise when your dog bites the burglar that broke into your house.
The Scenario
Jack was sleeping, and his dog Max was beside him, napping and dreaming of fun times ahead. Suddenly, there is a noise inside the house. It awakens Jack, and it awakens Max from his slumber. Max knows his job is to protect the home and rushes the burglar, knocks him down, and bites. The burglar suddenly regrets his choice and scatters to his feet to get away. Max bites him again before the burglar finally rolls out and quickly departs the scene. Initially, it looks like a standard breaking and entering, with the dog defending the home. However, the burglar can sue for damages.
The Claim
It turns out that the burglar has some rights. Some states declare that dog owners are liable for bites regardless of circumstances on public property or a private residence. Ultimately, if the burglar can prove Jack was negligent, he can get some compensation.
The burglar is suing Jack, alleging that he was negligent, allowing Max to attack him recklessly. Although the burglar had no right to trespass, he still alleges recklessness and can gain some compensation. The burglar complains that Jack should have restrained his dog after the first bite.
Takeaways
Most states have strict liability, meaning there is no defense if your dog injures someone.
While it may be difficult to believe you can be sued, even if the burglar does not prevail, you need to cover your legal fees, which run hundreds of dollars per hour. If your homeowners or renters policy do not include canine liability, you are left to deal with the mess yourself.
