When Your Dog Is Always Guilty
You and your dog are out for a walk minding your own business. Then, he reacts to someone coming near you in a predatory manner. Now, you are on the hook for a dog bite. Circumstances do not matter when your dog is always guilty when they bite a stranger.
The Scenario
Jenna is taking her dog Axe out for a walk. Axe is a protective dog, sometimes in an overprotective manner. One day, as Jenna is walking Axe, a man spots her from across the way. He walks toward her and begins to say something, but as soon as he gets close to her, Axe reacts and bites the stranger. Now, the man is filing a claim against Jenna.
The Claim
The man claimed he was walking over to talk to the woman to compliment her and the dog. Instead, he got a bite for his trouble. Jenna retorted that the man should have made his intentions clear had he wanted to speak with her in a friendly manner, instead of appearing out of nowhere. Ultimately, a misunderstanding caused Jenna’s dog to react, and her dog is always guilty, even in this scenario.
Takeaways
Axe misunderstood the man’s intentions toward his owner, whether it was friendly or predatory. Rather, Axe made a choice to protect his owner. Now it will cost Jenna and what could have been a friendship or courtship has instead turned into an ugly court battle in court. The man could have made his intentions clearer, but Jenna should have also controlled her dog’s behavior until she determined if the man was a threat or not.
